Braden & Tucci Serving Irvine

Orange County Felony DUI Attorney

Felony DUI Defense Backed by More Than 100 DUI Jury Trials

A felony allegation can threaten your liberty, driving privileges, employment, professional license, and criminal record. The first legal review should address the charge, arrest circumstances, chemical-test evidence, prior allegations, custody status, and approaching court or DMV deadlines.

At Braden & Tucci, we represent people accused of felony DUI offenses involving serious injury, death, repeat-offense allegations, and related enhancements. We handle both the criminal case and any separate DMV administrative hearing concerning an administrative license suspension.

Felony DUI Charges We Defend

Our practice focuses on DUI and DMV defense, including felony allegations involving multiple charges. Since 1997, we’ve represented more than 2,000 clients facing California’s impaired-driving laws.

Our felony DUI defense services include:

  • DUI causing injury: Cases alleging that impaired driving caused bodily injury to another person.
  • DUI manslaughter: Charges involving an alleged impaired-driving death and accusations of negligence.
  • DUI murder: Murder allegations arising from an alleged impaired-driving death.
  • Repeat DUI allegations: Cases in which prior convictions or other circumstances may affect how the offense is charged.
  • DUI enhancements: Additional allegations that may increase the potential punishment following a conviction.

How We Review Evidence & Prepare for Trial

Our review may cover the traffic stop and arrest, witness accounts, field sobriety tests, breath and blood testing procedures, equipment and calibration records, sample collection, and the prosecution’s theory connecting the alleged conduct to an injury or death.

We prepare each case for a potential trial while exploring available negotiation, reduction, or dismissal strategies. The appropriate course depends on the evidence, procedural history, prior record, alleged harm, California law, and your objectives.

Vincent Tucci has personally tried more than 100 DUI jury trials. He is certified in Standardized Field Sobriety Tests and in the administration, calibration, and maintenance of the Intoximeter Alco-Sensor IV preliminary alcohol screening device.

Felony Proceedings in Orange County Superior Court

The Orange County Superior Court Criminal Division handles felony and misdemeanor cases. Although the court provides online access to criminal case and calendar information, defendants should confirm their assigned justice center and appearance details through their citation, release paperwork, arraignment letter, or court records.

At a criminal arraignment, the court formally addresses the charges and receives a plea. Under California Penal Code section 825, an in-custody defendant may generally be held for up to 48 hours before arraignment, excluding Sundays and holidays, subject to the statute’s terms and exceptions.

Keep your arrest, booking, release, charging, and court documents together for your attorney. Don’t discuss the allegations on social media or make decisions about statements or pleas without case-specific legal advice.

What to Ask Before Choosing a Felony DUI Lawyer

A felony defense attorney handling a DUI-related charge should be prepared to address the criminal prosecution, technical evidence, and driver’s-license proceeding. The initial consultation should distinguish confirmed facts from allegations and identify which issues require additional records or investigation.

Ask prospective counsel about:

  • Experience handling the specific DUI-related felony allegation.
  • The approach to the criminal case and DMV proceeding.
  • The breath, blood, collision, or witness evidence that needs immediate review.
  • The purpose of the next court event and how you should prepare.
  • Who will communicate with you and perform the substantive legal work.
