Penalties for DUI Causing Injury

California classifies DUI causing injury as a wobbler, which means that it can be charged as either a misdemeanor or felony, depending on the circumstances of the accident. As such, there are different penalties for DUI causing injury at the misdemeanor and felony levels. 

For a misdemeanor, penalties can include the following:

  • Informal probation of up to 5 years
  • A license suspension of up to 3 years

The penalties for a felony offense are considerably more severe.

  • An additional 3-6 years in prison if a person suffers a significant bodily injury
  • A 5-year revocation of your driver's license
  • One strike toward California's three-strikes law

  • Being designated as a habitual traffic offender for 3 years

Enhancements Under California Vehicle Code § 23558

According to California Vehicle Code § 23558, any person who proximately causes bodily injury or death to more than one victim in any one instance of driving under the influence shall, upon a felony conviction, receive an enhancement of one year in state prison for each additional injured victim. The maximum number of one-year enhancements which may be imposed is three.
